Which U.S. States Have Legalized Abortion?

As of June 2024, 14 U.S. States have banned abortion:

  • Alabama
  • Arkansas
  • Idaho
  • Indiana
  • Kentucky
  • Louisiana
  • Mississippi
  • Missouri
  • North Dakota
  • Oklahoma
  • South Dakota
  • Tennessee
  • Texas
  • West Virginia

Although near-total bans exist in these states, most allow for exceptions in cases of rape or incest.

7 states have legalized abortion with gestational limits of 6-18 weeks:

  • Nebraska: banned at 12 weeks
  • Utah: banned at 18 weeks
  • Arizona: banned at 15 weeks
  • North Carolina: banned at 12 weeks
  • South Carolina: banned at 6 weeks
  • Georgia: banned at 6 weeks
  • Florida: banned at 6 weeks

29 states have legalized abortion, either up to the point of viability or with no gestational limit:

  • Washington: legal until viability
  • Oregon: no gestational limit
  • California: no gestational limit
  • Nevada: legal until 24 weeks
  • Montana: legal until viability
  • Wyoming: legal until viability
  • Colorado: no gestational limit
  • New Mexico: no gestational limit
  • Kansas: legal until 22 weeks
  • Minnesota: legal until viability

  • Michigan: no gestational limit

**Viability is defined as “the ability of a developing fetus to survive independent of a pregnant woman’s womb”. This point is generally considered to be between 22 and 24 weeks gestational age.
